關於車禍對方無照駕駛車子還是借來的

事情是這樣的對方於本月103年12月27號下午發生
因對方身體不適 (自稱)
開車突然跨越車道撞向我車
但是後來他的友人陸續到達(自稱他公司的人)
原先都說要處理
但是過沒幾天對方卻要我去找他本人(互丟皮球)
重點來了想請問有知識的人來幫我回答

對方的車子是跟他老闆的哥哥借的
肇事比例沒意外對方全責因為他跨越行車分向線撞到我的車
導致我的車被他撞到旋轉180度再來他本人說無法處理
那他跟他老闆的哥哥借車(因對方身體有殘缺)所以一定沒駕照
我可以跟他老闆的哥哥索賠嗎到十一定要對簿公堂
因對方無駕照本人非常確定 20點謝謝解答
