產創條例修正 違法後3年不得申請補助

立法院經濟委員會今天審議產創條例第70條修正案，朝野協商最終得到三點初步共識，包括企業若有重大違法事件，未來3年不得申請研發租稅抵減等相關補助。

立院經委會今天審議俗稱「日月光條款」的產創條例第10條、第26條及第70條修正案，但凡企業在環境保護、勞工、食品安全有情節重大者，需對政府提供之獎勵惠予以限制規範。

經濟部長張家祝認同，企業若有重大違法情勢，產創條例裡的投資研發抵減應予以取消。但多位立委主張，除了暫停及取消相關優惠，應訂「追溯」條款，追繳已取得之租稅優惠。

最終朝野協商初步達成三點基礎共識。第一，追回相關租稅的罰則，由立法院財政委員會處理；第二，違法期間，由行政單位舉證；第三，事發後3年內不得申請相關補助。
